APP AND WEB PRIVACY POLICY

  • We are committed to protecting and respecting your privacy. This Privacy Policy explains how your personal information is collected, used, and disclosed by Doctors E-Consult (Pty) LTD. This Privacy Policy applies to our website, www.dec.co.bw and its associated subdomains (collectively, our “Service”) alongside our application, Doctors E-Consult By accessing or using our Service, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms of Service.
  • Please note that the App interacts with other third parties (including GP’s and various healthcare providers). In some cases, we are simply processing your personal information on their behalf. Such third parties may also be data controllers in their own right and have their own privacy policies.

  • Personal Information means information that identifies you personally such as your name, photo, contact details, appointment details, medical record details or data that can be linked with such information in order to identify you.

  • Cookies are a small amount of data generated by a website or app and saved by your web browser. Its purpose is to remember information about you, similar to a preference file created by a software application

WHAT PERSONAL INFORMATION DOES DOCTORS E-CONSULT COLLECT

  1. Information You Give Us

    This is information you give us about you when filling in forms/screens on the App or registering for Services through Doctors E-Consult, any interactions you undertake or services you request or source through Doctors E-Consult and via any health or monitoring device you connect to Doctors E-Consult or by corresponding with us by phone, e-mail or otherwise. It will be clear at the time what personal information we are requesting from you. If you do not provide the personal information necessary or withdraw your consent for the processing of your personal information, where this information is necessary for us to provide Doctors E-Consult services to you, we will not be able to provide these services to you. You don’t have to provide data and can simply choose to stop using the App at any time.

  2. Information Automatically Collected

    There is some information like your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our platform. This information may be used to connect your computer to the Internet. Other information collected automatically could be a login, e-mail address, password, medical aid number, computer and connection information such as browser plug-in types and versions and time zone setting, operating systems and platforms, purchase history, (we sometimes aggregate with similar information from other Users), the full Uniform Resource Locator (URL) clickstream to, through and from our Website that may include date and time, cookie number; parts of the site you viewed or searched for; and the phone number you used to call our service centre. We may also use browser data such as cookies, Flash cookies (also known as Flash Local Shared Objects) or similar data on certain parts of our Website for fraud prevention and other purposes. During your visits, we may use software tools such as JavaScript to measure and collect session information including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page. We may also collect technical information to help us identify your device for fraud prevention and diagnostic purposes. We automatically collect certain information when you visit, use or navigate the platform. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about who and when you use our and other technical information. This information is primarily needed to maintain the security and operation of our, and for our internal analytics and reporting purposes.

  3. Information We Receive From Other Sources

    We may receive information about you from third parties to facilitate provision of the Services. This may include information provided from your General Practitioner or other healthcare provider such as your name, medical Aid Number and relevant contact details as well as sensitive information about you including your medical records and booked doctor appointments. They provide such data to us to enable us to provide the services to you.

HOW DOES DOCTORS E-CONSULT USE YOUR PERSONAL INFO

  1. Any of the information we collect from you may be used in one of the following ways:
    • To personalize your experience (your information helps us to better respond to your individual needs)
    • To improve our service (we continually strive to improve our service offerings based on the information and feedback we receive from you)
    • To allow us to investigate and address queries, questions and complaints that affect your use of the Doctors E-Consult App and website Services.
    • For internal operations, including troubleshooting, detection of fraud, log data analysis, testing, security, audit and statistical purposes. This is in our legitimate interest to protect our business interests and assess our business effectiveness.
    • To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs)
    • To process transactions
    • To administer a contest, promotion, survey or other site feature
    • To send periodic emails
  2. Where We Have A Legal Obligation

    To make disclosures as required by or in compliance with reasonable requests by regulatory bodies including the Botswana Professional Health Council, Botswana Medical Regulatory Authority or The Ministry of Health and Wellness, or as otherwise required by law or regulation.

WHEN WILL DOCTORS E-CONSULT SHARE YOUR PERSONAL INFORMATION

We will not sell your personal information and there are no additional processors we share your personal information with.

We may disclose your personal information:

  • To you and your GP or other healthcare provider in the course of providing the Services to you; or
  • If we are under a duty to disclose or share your personal information to comply with any legal or regulatory obligation; or
  • To enforce or apply our Terms and other agreements or to investigate potential breaches of such Terms; or
  • To protect the rights, property or safety of Doctors E-Consult Proprietary Limited, our customers, or others.

HOW DOES DOCTORS E-CONSULT STORE YOUR PERSONAL INFORMATION

We will store your personal information at our secure data centre. All data will be encrypted when being transferred to and from your device to Doctors E-Consult or to our data centre. It is your responsibility to keep any passwords or pin codes used to access Doctors E-Consult confidential.

We take all steps reasonably necessary to ensure that your data is treated securely through strict procedures and security features to prevent unauthorised access to your personal information. However, we cannot guarantee the secure transmission of information via the internet due to security threats outside our control and as such, any transmission of information is at your own risk.

HOW LONG DOES DOCTORS E-CONSULT STORE YOUR PERSONAL INFORMATION

We will retain your personal information for as long as needed to fulfil the purposes outlined in the ‘How does Doctors E-Consult use your personal information?’ section above or for a period specifically required by applicable regulations or laws. For example, we generally keep your personal information for as long as you remain a registered user of the App.

When determining the relevant retention periods, we will take into account factors including:

  • Our contractual obligations and rights in relation to the information involved;
  • Legal obligation(s) under applicable law to retain data for a certain period of time;
  • (potential) disputes; and
  • Guidelines issued by relevant data protection authorities.

Otherwise, when requested we securely erase or anonymise your personal information where you cease to be a user of the App and we no longer require your information for the purposes collected.

WHAT ABOUT THIRD PARTY SITES?

Doctors E-Consult or any other Service we offer may contain links to other independent third-party websites or mobile applications (“Third-party Sites”).

These Third-party Sites are not under our control, and we are not responsible for and do not endorse their content or their privacy policies (if any). You will need to make your own independent judgement regarding your interaction with any Third-party Sites, including the purchase and use of any products or services accessible through them.

WHAT RIGHTS DO YOU HAVE?

  1. The right to be informed

    You have the right to be provided with clear, transparent and easily understandable information about how we use your information and your rights. This is why we’re providing you with the information in this Privacy Policy.

  2. The right to rectification

    You are entitled to have your information corrected if it is inaccurate or incomplete.

  3. The right to restrict processing

    You have rights to ‘block’ or suppress further use of your information. When processing is restricted, we can still store your information, but may not use it further. We keep lists of people who have asked for further use of their information to be ‘blocked’ to make sure the restriction is respected in future.

    You have the right to lodge a complaint about the way we handle or process your information with your national data protection regulator.

The laws of Botswana excluding its conflict of law rules shall govern this agreement and your use of our service.

We update our privacy policy from time to time and any changes we may make to our privacy policy in the future will be posted online and, where appropriate, notified to you when you next open Doctors E-Consult. The new terms may be displayed on-screen and you may be required to read and accept them to continue your use of Doctors E-Consult.
